MOTOHAUS – TERMS AND CONDITIONS OF VEHICLE SALE
1. General

These terms apply to vehicle sales by Motohaus Limited, trading as Motohaus (“Motohaus”, “we” or “us”).

The invoice, order form, vehicle advertisement, written disclosures and these terms form the agreement with the Buyer.

Nothing in these terms excludes or restricts a Consumer’s statutory rights under the Consumer Rights Act 2015 or other applicable legislation.

2. Vehicle Condition and Description

The Buyer acknowledges that a used vehicle may show wear consistent with its age, mileage, price and previous use.

The Buyer will be given a reasonable opportunity to inspect and, where appropriate, test-drive the vehicle. This does not remove their statutory rights.

We make every reasonable effort to ensure vehicle descriptions are accurate. Any material known faults or mileage discrepancies should be recorded on the invoice or accompanying documentation.

Mileage is recorded as displayed and will only be described as verified where reasonable supporting evidence is available.

3. Deposits and Payment

A deposit reserves the vehicle and forms part of the purchase price.

If Motohaus cannot supply the vehicle, the deposit will be refunded. Where an order is expressly subject to finance approval and suitable finance is declined, the deposit will also be refunded unless the Buyer completes the purchase by another agreed method.

If the Buyer cancels without a statutory or agreed right to do so, Motohaus may retain a reasonable amount representing genuine costs or losses caused by the cancellation.

Full cleared payment, including confirmed finance payout, must be received before the vehicle is released.

4. Finance

Motohaus Limited acts as a credit broker and not a lender. Finance is subject to status, approval and the finance provider’s terms.

The vehicle will not be released until Motohaus has received cleared funds or acceptable confirmation of finance payout.

Withdrawing from a finance agreement does not automatically cancel the vehicle purchase unless the law or written agreement provides otherwise.

5. Standard Vehicle Warranty

Unless the invoice states otherwise, qualifying standard retail vehicles include a three-month warranty beginning on the date of collection or delivery.

Extended warranty products may be available for up to 42 months, subject to vehicle eligibility, an additional charge and the warranty provider’s separate conditions.

The warranty is issued to the Buyer named on the invoice and is non-transferable unless Motohaus agrees otherwise in writing.

6. Modified Vehicles

Modified vehicles include a three-month warranty covering eligible original, factory-standard components only.

Non-standard parts, performance components, ECU or gearbox remapping and faults caused or contributed to by modifications are excluded.

The vehicle must not be further modified or remapped during the warranty period without prior written approval. A claim may be declined where a modification caused or contributed to the fault or interfered with its diagnosis.

7. Warranty Exclusions

The voluntary warranty does not cover replacement required solely because of ordinary wear, ageing or routine maintenance, including:

Tyres
Brake friction components
Clutch friction materials
Batteries
Bulbs and wiper blades
Filters, fluids and routine service items
Exhaust components affected by wear or corrosion

DPFs, petrol particulate filters, EGR valves and catalytic converters are excluded from the voluntary warranty.

The warranty does not cover damage caused by misuse, neglect, accident, incorrect fuel or fluids, lack of maintenance, overheating, continued use after a warning or fault appeared, unauthorised repairs or modifications.

These exclusions do not remove any statutory rights where the vehicle or component did not conform to the contract when supplied.

8. Reporting Faults and Repairs

Faults must be reported to Motohaus as soon as reasonably possible. The Buyer must take reasonable steps to prevent further damage and stop using the vehicle where continued use could be unsafe or cause additional damage.

Motohaus must be allowed a reasonable opportunity to inspect, diagnose and repair the vehicle.

Warranty work must be carried out at Motohaus unless another garage has been authorised by us in writing beforehand.

Unauthorised work will not be reimbursed and may cause the affected claim to be declined where it causes further damage, alters the vehicle or prevents proper diagnosis.

In an emergency, the customer should contact Motohaus before authorising work wherever reasonably possible.

9. Repair Times and Courtesy Vehicles

Repair times depend on the fault, diagnostic requirements, parts availability and whether specialist assistance is required.

Motohaus cannot guarantee a fixed completion date but will aim to complete authorised repairs within a reasonable time and keep the customer informed of delays.

A courtesy vehicle may be available subject to availability, insurance requirements and the expected repair duration. It is not guaranteed and may not be comparable to the vehicle undergoing repair.

The customer is responsible for fuel, fines, tolls, damage and applicable insurance excesses while using a courtesy vehicle.

10. Consumer and Trade Sales

A vehicle sold to a Consumer cannot be deprived of statutory protection by describing it as “sold as seen”, “trade sale” or “part-exchange clearance”.

A genuine Trade Sale only applies where the Buyer is purchasing wholly or mainly for business purposes. Unless stated otherwise on the invoice, a genuine Trade Sale does not include the voluntary retail warranty.

11. Returns and Consumer Rights

There is no automatic right to return a vehicle purchased in person simply because the Buyer changes their mind.

If a vehicle is faulty, misdescribed or otherwise fails to conform to the contract, a Consumer may be entitled to repair, replacement, price reduction or rejection under applicable law.

Warranty expiry does not automatically end a Consumer’s statutory rights.

Qualifying distance or off-premises sales may carry a 14-day cancellation right. The Buyer may be responsible for return costs and any reduction in value caused by use beyond a reasonable inspection or test drive, where permitted by law.

12. Part Exchange

The Buyer confirms that any part-exchange vehicle:

Belongs to them or they have authority to sell it
Has no undisclosed outstanding finance
Has been accurately described
Has no undisclosed mileage discrepancy, major fault or insurance write-off history

Motohaus may revise or withdraw a valuation before completion if the vehicle’s condition materially changes or information supplied is inaccurate.

13. Collection, Insurance and Risk

Vehicles must normally be collected within seven days of being ready unless agreed otherwise.

The Buyer must arrange appropriate insurance and vehicle tax before taking possession.

Risk passes to the Buyer when they or their nominated recipient take physical possession of the vehicle.

Reasonable storage charges may apply following written notice if the Buyer fails to collect the vehicle as agreed.

14. Data and Complaints

Personal information will be processed in accordance with the Data Protection Act 2018, UK GDPR and our privacy notice. Information may be shared where necessary with finance providers, warranty administrators, regulatory bodies and other parties involved in the transaction.

Complaints should be submitted to Motohaus with the Buyer’s name, vehicle registration, purchase date and details of the issue.
